依你所述，行人未依規定穿越道路為肇事主因，我方責任須視筆錄而定。(可能無肇事責任，亦有未注意以及未減速之責任)

依道路交通安全規則
第九十三條
行車速度，依速限標誌或標線之規定，無速限標誌或標線者，應依下列規定：

一、設有行人穿越道、人行天橋或人行地下道者，必須經由行人穿越道、人行天橋或人行地下道穿越，不得在其一百公尺範圍內穿越道路。
