「陳佩琪條款」擬放寬 候選人配偶可助選

無黨籍台北市長參選人柯文哲的妻子、台北市聯合醫院小兒科醫師陳佩琪替夫助選，外界質疑陳佩琪具有公立醫院醫師身分，拉票等助選行為有違反公務人員行政中立法之疑慮，銓敘部今日向考試院會報告，提出修正「公務人員行政中立法施行細則」，放寬規定除站台外，還可助講、遊行或拜票。

不過今天院會上，多名考試委委認為相關規定修正應從修母法著手，銓敘部表示將「雙管齊下」。銓敘部表示，修施行細則並沒有政治考量，也沒有逾越母法之疑慮，發布施行後，不分政黨均一體適用。但今日提出後許多考委有意見，認為要修就從母法修，但因選舉迫在眉睫，考試院長伍錦霖已要求銓敘部長張哲琛立刻和立委溝通修法事宜，望儘速修改中立法第9條，另外施行細則修正草案也將預告至11月5日，11月6日此案再送院會討論。

立委指地下總統 金：請舉例

（中央社記者黃名璽台北23日電）民主進步黨立委陳歐珀今天質詢指國家安全會議秘書長金溥聰是地下總統，最有權力的人；金溥聰反問，能不能舉一個實例說明為什麼會做出這樣的推斷？

金溥聰接任國安會秘書長，首度赴立法院司法及法制委員會列席備詢。陳歐珀質詢時表示，相信金溥聰可能將接任行政院長，因為說其他人要接行政院長，誰都不相信，「只有你最有可能」；期待金溥聰真正負責，「不然你地下總統又不負責，我們也沒辦法監督的到」。

金溥聰說，他是公務員，一切都是公開接受監督。況且，總統馬英九非常肯定行政院長江宜樺的表現。

談到希望政府關注前總統陳水扁的醫療狀況，陳歐珀表示，金溥聰是最有權力的人，大家都知道；金溥聰反問，陳歐珀能不能舉一個例子，哪一件事讓陳歐珀做這樣的推斷？

陳歐珀說，金溥聰是一人之下、萬人之上，過去國安會秘書長也沒有像金溥聰這樣到處去巡查；金溥聰答詢說，每一個工作簡報都是歷任慣例；陳歐珀又說，歷任秘書長沒有人這樣做；金溥聰表示，可以送一份資料給陳歐珀看，「保證有」。

金溥聰表示，希望陳歐珀舉一個實例、少用形容詞、多用一些事實例子，來說明陳歐珀剛對他的評論。

另外，民進黨立委也聚焦在國安會組織與誰是國安會首長等議題。

民進黨立委段宜康稍早在會中質詢時表示，國安會既是一個會議，又是一個機關，機關首長是哪一位？金溥聰說，國安會主席是馬總統，秘書長定位是幕僚長；秘書長平常業務是幕僚長，審預算時就是名義上的首長身分。

段宜康認為國安會既然是一個機關，首長是誰？當然不是總統，總統不會是一個機關首長；因此，國安會的首長是秘書長。

金溥聰表示，國安會是跟情報有關的機關，在全世界各國都是一個非常特殊的單位。

金溥聰說，以美國來看，美國的國安會主席與召集人也是總統歐巴馬，預算同樣分別編在不同部會單位，因為本身是一個情治機關，所以必須有機密考量，否則一切都攤在陽光下，國家機密與安全就不存在。

另一位民進黨立委管碧玲質詢時說，依國家安全會議組織法，國安會秘書長角色是安置在國安會決議之下，秘書長必須依國安會決議去做。

不過，管碧玲引國家安全會議處務規程，認為處務規程卻把秘書長當首長，是子法逾越母法，應修法。

金溥聰說，有空時麻煩管碧玲轉告段宜康，段宜康剛一直要他承認他是首長；但管碧玲一再提醒他，總統無法出席國家安全會議時，代理的是副總統。

金溥聰在答詢管碧玲時還表示，管碧玲提到子法與母法在法律上的解釋，管碧玲有自己的看法，但在實質的運作上，所有的國安會議，到目前為止，統統都是馬總統親自擔任主席做成決議，「所以在實質運作上，完全沒有出現您剛才所說的違法亂紀的事情」。1031023

加拿大首都渥太華國家戰爭紀念館22日驚傳槍擊事件，一槍手朝1座戰爭紀念碑的衛兵開槍，然後竄入國會大廈。加拿大媒體的最新畫面顯示，警察進入國會大廈時，持槍小心翼翼地沿著走廊推進，當時氣氛相當緊繃。

案發當時，加拿大總理正在與國會議員對話，槍手幾乎已經站在會議室外，可說非常靠近總理。最後是一位陸軍中士將槍手擊斃，國會議員也迅速撤離。加國官方，不排除這起事件和加拿大決定加入攻擊伊斯蘭國有關係，但研判歹徒可能還有兩到三人。

中央氣象局表示，今天各地天氣多雲到晴、早晚微涼，日夜溫差可逾10度，東部有機會出現零星短暫雨。

氣象局說，今天各地大多為秋高氣爽、多雲到晴的型態，迎風面的東半部地區雲量還是較多，有機會出現局部的零星降雨，而西半部山區午後也會有些零星短暫陣雨。

氣溫方面，各地低溫大多在攝氏20到23度，早晚有涼意。

氣象局預測，晴朗少雲的西半部午間可以達到32、33度左右；東半部雖然雲量較多，最高溫也有機會接近30、31度。

氣象局提醒，各地日夜溫差較大，民眾要注意適時增減衣物。

Sony今年在IFA 2014期間公布的SmartWatch 3，稍早於Google Play正式上架，同時揭曉實際售價將是249.99美元，與日前已經開賣的Moto 360相同售價，但暫時還沒有確定具體上市時間，但有可能將在今年11月期間開放銷售。

Google Play稍早開放Sony SmartWatch 3上架，同時確定建議售價將是249.99美元，與日前已經開賣的Moto 360相同售價，但暫時還沒有確定具體上市時間。而由於SmartWatch 3改採Android Wear平台設計，因此或許將配合Google近期更新Android Wear之際同步上市 (而華碩ZenWatch也可能一同推出)。

至於SmartWatch 3未來是否將在台灣市場銷售，目前還沒有具體細節透露 (但先前已經確定Smartband Talk將進入台灣市場，SmartWatch 3則觀望今年秋季)。包含三星、LG、Motorola等廠商均宣布與Google合作Android wear平台產品，但目前僅華碩表態將在台灣市場推出ZenWatch。

Google預期將在年底前持續更新Android 5.0相關的作業系統內容，包含Android Wear、Android Auto與Android TV等內容。
