洛杉磯禁止以車為家 遭判違憲

洛杉磯禁止民眾以車為家的法律遭美國上訴法庭判決違憲，理由是該法條有歧視流浪漢與窮人之嫌。

美國聯邦第九巡迴上訴法院三名法官19日判定，洛杉磯1983 年制定禁止「在車上過夜、或把汽車當作棲身之處」的法條違憲，原因是該法未清楚界定以車為家何以違法，批評此法「將無罪行為犯罪化」。

法官派吉森在判決中指出：「在車裡吃東西，放睡袋、罐頭和書違法嗎？那在車裡講手機或躲雨呢？原告因這些行為被以違反社會秩序罪名遭到逮捕，但平常這些行為完全合法。」

四名曾因在車上堆滿雜物而遭警方以此項罪名逮捕的民眾，因不滿判決，而向上訴法庭提出訴訟，成功推翻下級法院的判決。
